But a Gallup poll shows 70% of Americans oppose having these facilities in their communities, citing higher utility bills, pollution, noise, and loss of green space. The real flashpoint, however, is the transmission infrastructure needed to power them.

When landowners refuse to sell easements for new power lines, utilities are increasingly turning to eminent domain — the government's power to seize private property for 'public use' with 'just compensation,' as enshrined in the Fifth Amendment. But does a transmission line built primarily to serve a single private data center qualify as public use? That's the question now playing out in courts across the country.

Eminent domain is typically delegated to states and local governments, which can pass that authority to private utilities. The U.S. Supreme Court's 2005 Kelo v. City of New London decision set a permissive precedent, allowing economic development as a valid public use — though that specific redevelopment project ultimately failed, and Pfizer left town. The calculus shifts when lines cross state lines and don't serve local customers. In 1984, the Mississippi Supreme Court rejected a condemnation because the line would have run from Mississippi to Louisiana without benefiting any Mississippi ratepayers.

The growing public backlash — and the patchwork of state-level reforms — means site selection and power procurement strategies need to account for regulatory and community risk, not just technical specs.
